Hearing in Priyanka case adjourned

Shimla, April 20

The High Court today adjourned the hearing on a petition filed by Priyanka Gandhi Vadra against the order of the State Information Commission (SIC) whereby it had directed the DC, Shimla to provide details of the land purchased by Priyanka at Mashobra to the RTI applicant.

The case was listed today before Justice Tarlok Singh Chauhan and on the request made by the counsel for the RTI applicant the matter was adjourned for May 11. The counsel for the RTI applicant sought adjournment on the ground that he has filed an application for placing on record some documents but the same was returned by the registry of the court with some objections and for removing the same he needs two weeks time. Allowing this request the court deferred the hearing on this matter for May 11.

Priyanka had filed a petition challenging the order passed on June, 29, 2015 by the SIC on the ground that the commission has failed to appreciate that information sought by RTI applicant Dev Ashish Bhatcharya was qua the property of the petitioner and the information was thus personal to her.

The DC had denied the information in his order on January 27, 2015 on the ground that since she was a SPG protectee, giving information could have a direct bearing on her security. He had cited the Special Protection Act, 2003 and also said that she was a VVIP and has been provided security by the SPG and this factor weighed with the state intelligence and also the President’s secretariat.
