Notice to Nahan MC over non-compliance of orders

Taking a tough stand on the issue of non compliance of its orders by the elected and nominated members of the Municipal Council, Nahan, the HP High Court today issued show-cause notices to all of its 17 members as to why they should not be prosecuted and punished under the Contempt of Courts Act and why the Municipal Council should not be dissolved.

The court passed these directions on a petition alleging encroachments in the Nahan town.

While passing this order, Justice Tarlok Singh Chauhan observed that from the perusal of the affidavit filed by the Executive Officer of MC, Nahan, clearly reveals that the elected and nominated members of the Municipal Council are out to scuttle and defy the orders passed by this court.

The court also issued show cause notices to Deputy Commissioner, Sirmour at Nahan and SDM, Nahan as to why they should not be prosecuted and punished under the Contempt of Courts Act.

While passing this direction the court observed, “Perusal of the records further reveals that the SDM Nahan and Deputy Commissioner, Sirmaur at Nahan, have also failed to comply with the orders passed by this court.

In its earlier order the court had directed the local administration and MC, Nahan, to take steps for removing illegal encroachment/ unauthorized construction in Nahan Town.

The court has also taken a serious note on the affidavit filed on behalf of the state government on the issue of illegal encroachments and unauthorized constructions in Nahan Town by observing “that the same is cryptic and bereft of any details.”
