Defamation case: HC seeks trial court record

Acting on a petition for quashing a complaint filed against AAP leaders by Punjab’s former Revenue Minister Bikram Majithia, the Punjab and Haryana High Court has called for the trial court record. The petition has been filed by Ashish Khetan, a colleague of Delhi Chief Minister Arvind Kejriwal.

Taking up the matter, Justice Fateh Deep Singh asserted during the course of arguments, it has been necessitated to call for the trial court record. Fixing September 29 as the next date of hearing, the Bench asserted the trial court record in original be requisitioned a day prior to the adjourned date. In case the arguments were not heard, the record be remitted back and recalled again in a similar manner.

Majithia had filed a criminal defamation case in May last year against the AAP leaders. The former minister had accused them of tarnishing his image through false accusations.

The complaint was filed for action against the leaders under Sections 500, 501, 502, 120-B and 34 of the IPC. A local court has already framed charges against Kejriwal, his party colleagues Sanjay Singh and Ashish Khetan in the defamation case.
